These Terms of Service (“Terms”) govern your access to and use of our website, apps, and related services (the “Services”). By using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services unless a parent/guardian consents where permitted.

2. Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We may use authentication methods such as one-time passcodes (OTP) via SMS/voice/email to secure accounts. You agree to provide accurate contact information and keep it updated.

3. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes
  • Attempt to gain unauthorized access to systems or data
  • Interfere with or disrupt the Services
  • Upload malware or harmful code
  • Harvest personal information without permission
  • Misrepresent your identity or affiliation

We may suspend or terminate access for violations.

4. SMS Terms (Authentication & Security)

If you provide a phone number, you may receive transactional messages for authentication and security, such as OTP codes, login alerts, or account recovery messages.

  • Opt-in: You opt in by entering your phone number and requesting a code.
  • STOP/HELP: Reply STOP to stop, HELP for help.
  • Note: Message frequency varies. Standard message and data rates may apply.
  • No Marketing: We do not send marketing messages via these transactional lines.
  • No PHI: We do not include sensitive health information (PHI) in text messages.

If you opt out, you may lose access to SMS-based authentication features. Alternative authentication methods may be required.

5. No Medical Advice; Informational Use

The Services may help organize information and facilitate communication. The Services do not provide medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions regarding a medical condition.

6. Provider/Client Organizations (if applicable)

If you access the Services through a provider organization or as part of a business relationship, additional terms (including agreements, BAAs, or enterprise policies) may apply between the organization and GetPreCare. Organization administrators may have access to certain account or usage details as required to administer the Services.

7. Intellectual Property

We and our licensors own the Services, including software, text, graphics, logos, and other content. You receive a limited, non-exclusive, non-transferable license to use the Services for your personal or internal business purposes, subject to these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Services except as permitted by law.

8. User Content

If you upload or submit content (“User Content”), you retain ownership of your User Content. You grant GetPreCare a limited license to host, store, process, and display User Content solely to provide and improve the Services.

You represent that you have the rights to submit User Content and that it does not violate law or third-party rights.

9. Third-Party Services

The Services may integrate with third-party services. Your use of third-party services is governed by their terms and policies. We are not responsible for third-party services.

10. Disclaimers

The services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.

We do not guarantee uninterrupted, secure, or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, GetPreCare will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the services.

Our total liability for any claim relating to the services will not exceed the amount you paid to us for the services in the 12 months before the event giving rise to liability (or $100 if you paid nothing), whichever is greater.

12. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, if required by law, or to protect the security of the Services.

13. Changes

We may update the Services and these Terms from time to time. We will post the updated Terms and update the Effective Date. Continued use after updates means you accept the updated Terms.

14. Governing Law; Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any disputes will be resolved in the state or federal courts located in California, unless applicable law requires otherwise.
